  • Hello, I am a freelancer who must invoice a North American Company. Have I to add 23%VAT to the total or not? And if YES, how can the client have back this 23% from the Italian State? Thank you for your help! All the best!

If you’re a professional with VAT position in Italy and have to invoice an american company based in US for a job that has been done in Italy, first you have to make the american W-8ben document, than make the invoice without VAT and pay taxes in Italy on the brutto, declaring to the Agenzia delle Entrate the sum you received.

Thank you Ewa! (If I can… what is the american W-8ben document?)

the W8-form is for suppliers outside of the us. no harm in filling it, for most us-based companies its anyway part of the contract.

europe-> us is subject to reverse charge-mechanism. u only have to mention this on the bill, then u can charge without vat, but as said, some paragraph must be there mentioning reverse charge (was introduced in 2010 to facilitate international business).
